Terms of Use & Privacy Policy
LAST UPDATED: JULY 10, 2021
July 2018 Changes: We thoroughly revised this document to make it plain language and to make it easier to contact us. We also provided more information about our outside services and how they relate to privacy. Lastly, we switched from an "everything is ours" mentality to Creative Commons (we think you should do the same).
Jul7 2021 Changes: We updated all email and web addresses to our new domain of creedon.com, and our mailing address as well.
PLEASE READ THESE TERMS OF USE AND PRIVACY POLICY CAREFULLY. BY ACCESSING OR USING THIS WEBSITE, YOU AGREE TO BE BOUND BY THIS DOCUMENT. IF YOU DO NOT AGREE TO ALL OF THESE TERMS, DO NOT USE THIS WEBSITE.
Introduction
This document, our terms of use and privacy policy, applies to your use of the Creedon PLLC website at www.creedon.com, and to the information and services we provide. By using our site you agree that you've read this document and that you, or an entity you represent, are bound by it. If you think this document is terrible, please let us know — but be aware that your use of the site is bound by these rules until we make a change. (Did you convince us to make a change? Great job! Check the header above to see the last date we modified this document and a summary of the new content.)
Purpose of Our Site
The information we provide on our site is solely to share our knowledge. We cannot provide legal advice on our site — after all, we know little about you and your current legal situation. We also cannot form an attorney-client relationship with you simply by you using our site (although we'd be happy to chat over any legal issue you may have if you contact us here). You should always seek professional legal counsel from an attorney admitted to practice in your location, and should not simply rely on the content of a website. Even awesome sites like this one are meant to be general and informative, not definitive sources for legal problem solving.
Privacy
We take your privacy seriously and we will do our best to protect it. Here are some key points to keep in mind regarding your private information:
Our site is hosted on Squarespace, which uses both Google Analytics and Squarespace Analytics to collect information regarding your visit to the site. This includes information such as when you visited, where your IP address was located, how you came to our site, and which pages you viewed. We use this information to improve our products and services, to identify which items are most popular, and to develop our site and our business to better serve our clients. We do not save or maintain any of this data except through Google Analytics and Squarespace Analytics services.
If you submit information using our Contact Us form or the newsletter Subscribe form, that information gets sent to us and we collect it. That said, PLEASE DO NOT SUBMIT CONFIDENTIAL INFORMATION VIA THE CONTACT US FORM OR THE NEWSLETTER SUBSCRIBE FORM. Think of these forms as the way we first get introduced — a good start to a conversation, but we're not in a relationship yet. Once we get in touch with you, we can work through how to learn more about your specific situation.
We do our best to keep your information secure by using internal procedures and file storage services which limit access to user data. Our firm keeps very few paper files, and generally does not store data submitted through our website either in our local computers or in any physical form such as printouts. Rather, aspiring to be paperless, we utilize Google G Suite for Business and access data using Google Drive and File Stream.
Copyright
Except where otherwise noted, the contents of our site are licensed under the Creative Commons Attribution-NonCommercial 4.0 International License. We encourage you to review this Creative Commons license and to use a similar license on your own creations. Stewart Brand, cofounder and president of The Long Now Foundation, once said "Information wants to be free" — and we agree. Please use our content responsibly to contribute to humanity's progress. That said, we know copyright issues can come up, and ask you to contact us immediately if you believe any material on our site infringes on any copyright you own or control. Our Designated Agent is James H. Creedon, Creedon PLLC, 5 Cowboys Way, Suite 300, Frisco, Texas 75034, 972-850-6864, jhcreedon@creedon.com.
Trademarks
The look and feel of our site includes our trademarks and trade dress, and we ask that you don't imitate them without permission. If you really love what you see, or want to develop your own site, let us know and we'll have a chat! All other trademarks, registered trademarks, product names, company names, or logos mentioned in our site are the property of their respective owners, and we have no power to give you permission to use them. If you think we can make a useful introduction so you can make the request, just ask.
Third Party Sites
We sometimes link to outside websites (even in this document!), but we can't promise you anything about the quality of those sites or accept responsibility for their content. We don't control those sites and you need to review the terms and conditions for any site you visit to understand how they work. Like with playing Luigi on the old NES, "my house, my rules."
Attorney Advertising
Our website and the information contained within it may be considered attorney advertising. Even if we talk about cases we've handled, or offer insights on legal issues generally, we want to emphasize that results in legal matters depend upon a host of unique factors. We cannot guarantee any success on current or future matters, nor can any attorney — we live in a world of uncertainties.
Disclaimer and Limitation of Warranty
We provide our site, and the information on it, on an “as is” basis, without any kind of warranty. We don't assume liability for any direct, indirect, consequential, or other damages whatsoever arising in connection with our site or any of its contents. If you see an error on our site, or have any issue you would like us to address, please tell us immediately.
Applicable Law and Venue
We certainly hope we never have any legal issues with visitors to our site, and we will do our best to resolve any matters informally. If we can't, you agree that you'll submit any legal issues for mediation here in our home county of Collin County, Texas, and that you'll do your best to work out a reasonable solution. If we can't get the matter resolved by mediation, you agree that these terms and your use of the site will be under Texas law. If a lawsuit is necessary, it will be filed in the state or federal courts of Collin County, Texas, it will apply Texas law, and it will only be heard in Collin County, Texas.
Changes to Terms and Enforcement
We have the right to change any of these terms and any of our policies at any time, and (again) we'll let you know by the dateline and summary in the header. Once we make a change, it magically propagates through the world and is effective immediately. If you keep using our site, you have accepted our changes. If you don't like the changes, you should stop using the site until you are happy with the new rules. We have the right to terminate your access to our site, or even block you, without giving you notice. If you think you've been blocked or improperly terminated, please drop us a line. (Just in case you are saving this document in a format which doesn't support links, call us at 972.850.6864 or email us at contact@creedon.com.)
Conclusion
At Creedon PLLC, we want to be the very best firm we can be — which includes respecting our site visitors and using plain language to explain where everyone stands. If you think could do a better job on this document, send us your edits. If you are an attorney, send us your resume too!
